Anne, I've been sued twice-the first time I was fortunate in that it was for a debt that had been settled 4 years ago and I had some of the paper work I needed to prove it. Also, at this time, Iam working for a lawyer so I had free legal advice. Of course, the other law firm was extremely rude when I explained to them in a letter that it had all been taken care of-so we ended up going through all the legal rituals of initial disclosures and discovery. I'd have to say that it was after discovery that they starting thinking this was not a case they should have gotten into. when a hearing came up-my boss went with me, I had the documentation from from the now defunct debt resolution company, the trust acct. banks sent copies of the checks they had sent, from the acct I was paying into, to the credit card co.-Chase, and the acceptance letters from chase that the settlement was ok'd and taken care of. Case dismissed. the other law firm was pretty bummed when they realized they had bought a debt that was no longer a debt. They now had to deal with Chase and get their fees taken care of and the money back that they had paid.

2nd one was a bit of a surprise in that a letter arrived from the same law firm with another lawsuit! I think I wrote them a letter explaining I had never had a card with the number they were claiming was mine-again true-and that they needed to check their facts again.

Haven't heard from them since/

Now those are two situations that went in my favor-I was lucky with one that I kept semi-good records for several years and had documents that could lead me to others to show proof of my claim. the second time, I think they realized pretty quick who it was they were suing and just didn't want to deal with me again. Luck. Doesn't mean I haven't heard the end of that one.

Most states have a statute of limitations, where a company cannot sue you if their claim is a certain amount of years old. Most of my credit card debt is approaching that time I think, and once that time comes, it is off the record, the company cannot collect or sue. different states vary in their limitation standards and it may or may not be different for standard contracts (like a business contract) and credit card contracts.

Go to Fair-debt-collection.com and read everything they have. Some sections may not app;y, some may help with dealing with a lawsuit, some can help you deal with credit reports and how to get incorrect info removed and how to dispute any thing in the report. ALso, once a you let the credit reporting agencies know some part of the report is being disputed, it has to be stated on the report that it is in dispute-which looks better for you and not so good for the other side.

I'm not saying any of this very well, but please check out the Fair debt site and also fair-credit-reporting.com sites. They are very helpful, reassuring and helps put us back in control.

I know this didn't exactly answer your question but those two websites can give you useful info before you deal with the opposing lawfirm.

Hello to all! I had to sign up here. I can see I have some mutual business people from outside the vou system already. I am hoping to gain and give much support here, kind of new to the online aspect of things but hopefully this group will help me catch on. I don't know if anyone is a Yankee Fan but I am going to be giving away seats to Opening Day through my blog UltimateYankeeFan.com it is currently in pre-launch status, however if you register at the blog you will still be entered in the drawing for tickets. I am open to suggestions on prettying it up as I said it is still pre-launch but mechanically working! Let's go Yankees!

Anne, I know a little bit about collections. Someone recently contacted me because they got served by a constable. I had them call the law firm. They did so and explained their situation and why they stopped paying their credit card bill. They were actually very nice over the phone and understanding. It turned out that they didn't have to go to court and that the office would accept $50 per month. Not bad considering they now owe close to $6,000. Those firms usually have 6 months to try to collect the debt. But I suggest you call them and tell them your situation. If they arrange a payment plan, ask for something in writing.

Say, is anyone being sued by their creditor? I started having financial difficulties back in October 2007 after I lost one of my two jobs. I have since joined alot of online ventures that I thought would bring the extra cash I needed to stay caught up, but to no avail. I now find myself being sued by one of my creditors and I searched the internet trying to find answers as to how to handle this without a lawyer - but still haven't had any luck with that either. Can anyone tell me if there is a way out of this without going to actual court? Should I just call the law group that got the summons on me and see if I could work it out with them? Or should I do everything by mail? Please email me at lazan2008@gmail.com.

My suggestion to everyone is to double check and verify every item on their credit report. I have about 6-8 items on my report that I was not aware of, when I called these companies they told me they have no record of me in their system, now how their information got on my credit report is beyond me, so now I have to dispute these items to have them removed from my credit report. It does not hurt to be careful.
